What happens if immigration application is denied?

The Canadian government has its own eligibility criteria and requirements for immigration programs to check the quality and quantity of the influx of immigrants from different parts of the world.  It primarily aims to boost up its population and economic graph with the help of immigration. So, most of the times, when it finds applicants ineligible for its market, society, and culture, it rejects or refuses the immigration applications.

However, for an applicant who fantasizes of living, studying or working in Canada, the letter of rejection is not less than his/her worst nightmare.  So if this applies to your immigration case too, then this post is of great help.

Contrary to disappointment for denial of Canada immigration application, an individual has three options including - appealing, reconsideration, and re-applying for getting refusal overturned in the short duration of 30 days only.

However, before all of them, the foremost thing is to understand the reason behind the denial of your immigration application.

Reasons for which immigration applications get denied:

·        Misrepresentation:

If an applicant unintentionally forgets to provide any information or document required for the immigration program, then he/she may get accused of misrepresentation. Immigration examiner doesn’t approve incomplete immigration applications or applications with improper documentation or false information.

·        Health reasons:

Canada is popular for its healthy environment and free healthcare services. Any diseased or unfit applicant may overburden its health care system so, it is mandatory for every new applicant to be mentally and physically fit to enter Canadian boundaries as any visa holder. In case the medical report states any health issue, then it becomes difficult to get approval from the immigration examiner on the immigration application.

·        Failure to provide PCC:

Police Clearance Certificate (PCC) is to prove that an individual doesn’t belong to any criminal background. If an applicant fails to provide PCC directly leads to the rejection of immigration application.

·        Lack of proof of funds:

Many immigration programs of Canada demands proof of funds to ensure that the applicant is financially stable to support him/her in Canada after immigration. So, all those applicants who are unable to show sufficient funds to an immigration officer have to face denial of immigration application.
Once you are aware of the reason for rejection, the next step is to appeal, request reconsideration or re-applying depending on your case.

Appeal and reconsideration:

If an applicant genuinely believes that immigration examiner made an incorrect or wrong decision, then he/she has an option to appeal. With the assistance of an experienced immigration lawyer or consultancy which is well-versed in dealing refused immigration application, he/she can appeal either to the Federal Court of Canada or the Immigration Adjudication Division (IAD). Here, you need to put your grounds for the appeal against the decision of immigration officer. However, remember, IAD hears cases only from sponsored persons applying to Permanent resident visa.

If an applicant believes that immigration examiner has misunderstood the provided information, then Reconsideration is a good option.

Re-applying:

When an applicant receives the letter of rejection from CIC, it clearly mentions the reason for denial of the immigration officer. If it says that he/she may reapply for the Canada visa at a later date, then it is advisable to him/her to initiate the process of reapplication without any further delay. Moreover, hire a trustworthy and reputed consultancy which knows the detailed reapplication procedure to avoid any chance of rejection or denial the second time around.

How Can I Apply for Canada visa after rejection?

Undoubtedly, Canada is a great place to live, work or study. As a result, every year, it receives visa applications from different corners of the world in bulk. However, unfortunately, many of those get rejected or refused by the Canadian department. Reasons for rejection may vary according to the type of visa application and clearly mention in the rejection letter.

For instance, in the case of the student visa, an applicant needs to provide a letter of acceptance from a Canadian university or college, where he/she is going to pursue his/her further studies. If he/she fails to meet this requirement of the program, the immigration department will never approve the application.

Similarly, if it’s a Canada business visa and an applicant fails to provide funds for a minimum investment or personal worth, then refusal visa application will come as a result.

Other common reasons may include false or fake information, delay in payment of processing fee, failure to meet medical conditions or international security standards and more.

So if you have received a letter in the mail from Canadian immigration authority for rejected or refused visa application, then instead of losing hope, you may request an appeal or reconsideration after rejection according to your case.

Appealing can be beneficial after Canada visa rejection if your legal immigration consultant has some hope of getting refusal overturned in your case. Like, if you have submitted the incomplete or incorrect application form, then, in that case, you can appeal to complete or correct things with a good explanation for why you have missed this information at the time of the earlier submission.

In addition to this, remember, there is a short window of time for appealing so make sure, you armed with the correct reason of rejection and then accordingly choose your way to deal it. In case, you don’t understand the reason for rejection, do an Access to Information and Privacy (ATIP) to get complete information on the same.

To fill the ATIP, the mandatory requirements are:
  • An individual must be either a Canadian citizen or permanent resident; or,
  • If he/she is a foreign national, then it is necessary for him/her to be physically present in Canada; or,
  • If he/she is a foreign national and unable to come to Canada, then he/she needs a representative who can fill AITP for him/her and it requires a consent form from an applicant

So once you fulfill the above requirements, then you need to visit ATIP homepage where you get the option to choose your preferred language and the department to submit the request. Fill the required details there along with your valid e-mail id. At the final stage of processing request, you need to upload documents and consent form (if required). Check you're filled credentials and make the payment of the fee for ATIP. Your requested department will process your ATIP request, and in general, it will not take more than 30 days.

On getting detailed information on rejection, you can seek help from an experienced and trustworthy immigration consultancy which knows how to present refusal visa cases for appealing in front of the Canadian immigration department. For complete information on refusal Canada visa case analysis, contact experts of countrywide visas. How long does it take to sponsor a spouse to Canada?

Being one of the most favorable countries in the world for immigration, every year Canada receives applications in bulk for its different immigration categories. Applications for spousal sponsorship are one of them.

Spousal sponsorship allows a Canadian citizen or permanent resident to sponsor his/her partner for permanent residency in Canada.

In general, a spouse is a broad term in relation to the Canadian immigration process. It includes three kinds of partnership:

·        Marital relationship:

In a marital relationship, the partner of a sponsor is either a wife or husband. He/she legally married to sponsor and has gone through a completely legal process in the native country or Canada. Marriage certificate along with some photographs of marriage is necessary for verification and evaluation of applications.

·        Common-law partnership:

In the common-law partnership, sponsor and his/her partner must have been living together continuously for a minimum of one year. Documents like:

  • Joint bank account statement; or,
  • Credit card statement involving the activity of both partners; or,
  • A the salutatory declaration signed from both partners and stating that the relationship between them is true and genuine; or,
  • Renting the lease on the name of both partners; or,
  • Pictures of dates or trips, conversations, phone call logs and more are required to prove the status of the relationship

·        Conjugal partner relationship:

In conjugal partner relationship, sponsor and his/her partner have been in a marriage-like relationship. However, due to circumstances like immigration barrier, marital status, and more which are beyond the control of both partners, they have not allowed living together continuously for one year. Here, it is difficult to judge the relationship so require a strong reason which is not merely based on convenience.
So if you qualify the following list of eligibility, then you can sponsor your spouse for Canadian permanent residence.

Eligibility of a sponsor:

  • A sponsor must be at least 18 years old and:
  • Canadian citizen or,
  • A person registered in Canada as an Indian under the Canadian Indian Act or
  • A permanent resident of Canada
  • He/she must not be bankrupt or charged with any debt or offense
  • He/she must not sponsor as a spouse in the past five years
  • He/she is able to meet the basic requirements of his/her sponsored partner after immigration to Canada
  • He/she must pay immigration bond, performance bond, and family support payments on the scheduled timeline
  • He/she must not receive any social benefit for a reason other than a disability
  • He/she must not charge in any sexual offense
  • He/she must not be in a penitentiary, jail, reformatory or prison

Length of the process for spousal sponsorship:

It takes nearly 12 months in getting final approval on the application for a spousal sponsorship. Remember, it’s a general idea as there are many factors due to which applicant need to wait longer for immigrating to Canada.

Some of the most popular reasons for the delay in processing time are:

·         Incomplete documentation:

As stated earlier, the Canadian government requires documents to verify the eligibility and status of the relationship between the sponsor and his/her sponsored partner. So if the given information and documents are not complete or contain errors, or copies are difficult to read, then it may delay the processing time of applications, and in worst scenarios, it may become the reason of rejection too.

·         A large volume of applications:

Sometimes when the government receives a large volume of applications for spousal sponsorship, then it increases the processing time of applications.

·         Non-payment of fees:

If the candidate fails to pay fees on time, then it may add days or weeks in the processing time of his/her application for a spousal sponsorship.

How can you ensure your application for Spousal Sponsorship gets processed as quickly as possible?

It is worth noting here that it is always in your best interest to have the support from an experienced immigration consultancy through the process. Is it compulsory to visit Canada after getting PR visa from India?

Undoubtedly, getting approval for Canadian Permanent Residence (PR) is itself achieving a milestone as the application process for PR involves several complexities like eligibility criteria, CRS score, documentation and more. Canada is the most surveyed immigration destination among Indians especially North Indian families. They grow up with only one dream in their mind that is Canada. So, it can be expected how overwhelming the moment is for them when they get the chance to immigrate to Canada to fulfill their childhood dreams.

However, surprisingly, most of the people don’t know what to do next after receiving a positive confirmation for PR.

Remember, once the authority has approved the application for PR, they would mail:

·      A Confirmation of Permanent Residence (COPR); and
·      A permanent resident visa (if an applicant is from a country like India that requires a visa).

Now, if you are residing already in Canada, then you need to contact officer at the Canadian port of entry (border crossing) and present credentials like confirmation of permanent residence (COPR), permanent resident visa (if provided), proof of funds to support you and your family in Canada. The officer will ask you a few questions to ensure that you are eligible in all terms for living in Canada.  Moreover, he will confirm your Canadian mailing address where you will receive your PR card.

If you are from India or any other country, then you have to visit Canada after getting PR visa within one year. It is worth noting that you cannot enjoy the status of Canadian permanent residence unless you visit there and get your COPR stamped.

On arrival at the airport, you will meet officers from the Canadian immigration department. They will provide you with application forms for all the necessary documents which you will need during your stay in Canada like

  •  Social Insurance Number (SIN) card:

This number enables newcomers to apply for any job or government assistance or credit in Canada.  Without it, you don’t have any identity there, and you are not eligible for any benefit of the PR visa holder.

Application forms for a driver’s license

  • A health care card:

The biggest advantage of immigrating to Canada is free health services. The Canadian government offers free Medicare to its all citizens registered under the national insurance program. However, in most of the provinces, it takes three months to newcomers in getting benefits from the public health care system. So, it is suggested to fill the application form soon after landing in Canada.

  • Permanent resident card:

This card is of the utmost importance for an immigrant in Canada. It is proof of your legal acceptance in Canada.

Next, you will meet officers from the Canada Border Services Agency (CBSA). He will ask a few questions to ensure that you are the same person who got approval to immigrate to Canada. So, you need to be ready with all your documents like proof of funds for you and your family, a valid passport, COPR and a local Canadian address where you will get your PR card after around 60 days.

Note: if you are going to change your mailing address within 180 days of getting PR status, then it is compulsory to inform the authorities about the same.

After the short interview and verification, you will get the landing confirmation document. It enables you to live in Canada with PR status; however, without having a PR card.
So if you are also interested in immigrating to Canada, then choose one of the Canadian immigration programs according to your eligibility and apply for it. As under the three-year immigration program, the Canadian government is going to welcome more than one million new immigrants as permanent residents by 2021 so, this is the right time to turn your dreams into reality.

Minimum eligibility requirements for Canada PR include:
•    An applicant must be at least 18 years of age; however, Indians of age group 25-35 years immigrate to Canada the most

However, if he/she has completed education outside Canada, then Education Credential Assessment (ECA) is mandatory. ECA is important to show that diplomas or degrees an applicant has are equivalent to the minimum requirement of the Canadian education system. In India, World Education Services (WES) issues the ECA, which costs around 20, 000 INR.
•    He/she must have an official experience certificate for at least one year in a full-time paid job field (number of years may vary according to the program)
•    He/she has a scorecard of language proficiency test like IELTS, TEF and more with a minimum required CLB level
